Difference Between a DUI and DWI

DUI and DWI are both terms used to reference operating a motor vehicle while you are impaired by alcohol or illegal drugs. DWI stands for “driving while intoxicated”. The similarities between DUI and DWI are:

  • Both DUI and DWI are criminal charges

  • Both DUI and DWI carry severe penalties with mandatory sentencing guidelines

The differences between DUI and DWI include:

  • The alcohol levels of DWI are 0.08 or greater. Alcohol levels greater than 0.15 in Arizona is considered an extreme DWI, or a super extreme DWI if the alcohol level is greater than 0.20

  • A DWI conviction requires a measurable amount of alcohol in your body within two hours of driving or having actual physical control of your vehicle
